Terms and Conditions of Use

By using this website or receiving any services supplied to you (the “Customer”) by NAMAK Enterprises, LLC d/b/a Premiere Services Solutions (“PSS”) and/or downloading, installing or using any associated software or mobile application supplied by or in connection with services provided by PSS (collectively, the “Services”), you are agreeing to be bound by these website Terms and Conditions of Use collect, all applicable laws and regulations, and agree that you are responsible for compliance with the Terms and Conditions of Use stated herein as well as any applicable local laws (collectively the “Agreement”).

PSS does not warrant that any of the materials on its website are accurate, complete, or current. PSS reserves the right to modify the terms and conditions contained in this Agreement or its policies relating to Services at any time, effective upon posting on its website located at www.premieresolutionservices.com.  The Customer is responsible for regularly reviewing this Agreement and continued use of the Service shall constitute the Customer’s consent to any modifications or changes to the Agreement. However, PSS does not make any commitment to update the materials.

Use License

Permission is granted to temporarily download one copy of the materials (information or software) on Premiere Service Solution website for personal, non-commercial transitory viewing only related to securing an order for services to be rendered by PSS. This is the grant of a license, not a transfer of title, and under this license you may not:

1. modify or copy the materials;
2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
3. attempt to de-compile or reverse engineer any software contained on PSS’ website;
4. remove any copyright or other proprietary
5. notations from the materials; or
6. transfer the materials to another person; or “mirror” the materials on any other server.
7. This license shall automatically terminate if you violate any of these restrictions and may be terminated by PSS at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

Disclaimer

The materials on this website are provided “as is” without warranties of any kind, either expressed or implied, including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. PSS expressly disclaims and negates any and all other warranties. Further, PSS neither warrants or makes any representations concerning the accuracy, likely results, or reliability of the use of the materials on this website site or otherwise relating to such materials or on any sites linked to this site.  Your use of this website is at your sole risk and you assume full responsibility for any costs associated with your use of this website.  PSS shall not be liable for any damages of any kind related to your use of this website.

In no event shall PSS be liable for any damages (including, without limitation, damages for loss of data or profit or loss due to business interruption,) arising out of the use or inability to use the materials on this website, even if PSS or a PSS authorized representative has been notified orally or in writing of the possibility of such damage. To the extent you reside in a jurisdiction that do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

Moreover, PSS is not responsible for the contents of any site linked to its website. The inclusion of any link does not imply endorsement by PSS of the site or its contents. Use of any such linked web site is at your own risk.

Independent Contractors

All cleaning specialists utilized by PSS are independent contractors (“Service Professional”) and are not employees of PSS.  PSS performs due diligence and takes reasonable steps to vet and onboard cleaning specialists who are experienced in providing cleaning services.  PSS conducts interviews, background checks, and reference checks. Service Professionals warrant and represent that they, and their employees, contractors, subcontractors, agents or employees who may perform work for them, are experienced and properly insured as required by applicable laws or regulations to which they may be subject in the jurisdiction or jurisdictions in which they offer their services and as individuals or businesses contracted with PSS.

PSS does not accept liability on the suitability of the Service Professional(s) to complete the jobs or the quality of the outcome.  Any and all claims of any kind related to damage, theft, or the like that occur during the performance of the job will be the responsibility of the Provider.

Services

To utilize services provided by PSS, you agree to register and create an account for your persona or business use only.  You may not authorize others to use your account and you may not assign or transfer your account to any other person or entity. When you create an account you warrant that the information you provide is true, that it relates to you and is entirely accurate. We may reject the creation of an Account at our absolute discretion.

Once you have registered and booked a service, PSS will assign a Service Professional we consider best able to complete the service.  Customers are required to provide a credit-card for authorization at the time of booking.  Payment for the services is made when the cleaning is complete and any applicable discounts applied.  The Customer agrees to hold sufficient funds in their account to pay the final amount as it becomes due and authorizes PSS to complete the payment upon completion of the service.

Booking: Booking a service online does not guarantee you a spot for that date/time. You will be contacted by email with a confirmation.

Arrival Window:  We cannot guarantee an exact arrival time, but do offer a 30 min call ahead of the scheduled time for service. PSS reserves a right to a thirty minute (30)  arrival window for the cleaning specialists to arrive due to traffic, parking, or other unanticipated circumstances.

Price Adjustments: If the pricing calculator underestimates the price of your cleaning and the condition of your home is much worse than predicted or the Provider is not happy with the price given, we do have permission to either adjust the price or refuse the service.

Cleaning Time:  The first cleaning is quoted based on a normal home condition.  If upon arrival, it is determined the job requires extra time, we will call you for authorization for additional time and/or additional costs.

Cleaning Supplies: PSS cleaning specialists will provide all of the cleaning supplies needed to conduct a normal home cleaning. PSS makes no representations regarding the products used, including, but not limited to effectiveness, quality, environmental effect, or odor.

Specialty products: If you would like us to use specialty products, please leave it out and include this request in your special account instructions.

Pets: PSS is an animal-friendly business; however, not all of our Cleaning Specialists are as comfortable around all animals.  We will do our best to work around your pet, but we ask that while the Service Professional is present for the cleaning, please restrain your pet in a safe and comfortable area to avoid contact with the Cleaning Specialists.

Lock box: Clients can leave a key in a safe place for the Cleaning Specialists if you choose not to be at home during the cleaning.  Just let us know at the time of booking if you have special instructions for entry.

Right of First Refusal.  PSS Service Professional reserve the right to leave upon arrival if the home is in an extreme condition or if the Service Professional reasonably feels unsafe or threatened.  Under these circumstances, you will be charged a fee in accordance with our cancellation fee policy.

Damage/Loss Policy. In order to submit a claim for damage or loss, the Client must provide photos of the damaged and/or loss depicting the condition before and after the cleaning as well as the estimated cost of the damage/loss.  All claims must be made within 24 hours of the conclusion of the cleaning.  All claims should be sent to contact@premiereservicesolutions.com. PSS reserves the right to deny claims not properly submitted within this time period.

Payments: At the time of booking, customers will need to provide a credit/debit card to reserve booking time.   PSS will not charge the card until the cleaning is complete.  A hold will be placed on your account (for authorization) one (1) day before the service is scheduled in the amount of the total balance to ensure funds are available.  This hold is NOT A CREDIT CARD CHARGE.  If your service is cancelled, the hold will be released and the cancellation policy applies.

Photography: Customers grant permission to Premiere Service Solutions and/or its authorized representatives to capture non-invasive and non-identifying photographs of the before and after cleaning services provided.  You further authorize its assigns and transferees to copyright, use, and publish the same in print and/or online purposes of advertising Premiere Service Solutions.  The materials will become the property of Premiere Service Solutions to be used in any manner the company deems appropriate.  You waive any right to compensation for said photographs and the right to inspect or approve before use.  You understand these photographs or portions thereof will be used for public view, such as, but not limited to any social media platforms and on the company’s website. If you choose to opt out of the use of any photographs, you must do so in writing and send to Premiere Service Solutions at its listed address.

Cancellation Policy

For one-time cleans, a fee of $50will be charged if the Cleaning Specialist is unable to access your home on the date and time of the scheduled service or if there is a cancellation less than24 hours of the scheduled service time.

For prepaid recurring Clients, if a repeat clean is cancelled less than 48 hours of the repeated scheduled clean, a $50 cancellation fee will be assessed.

Offers and Promotions

PSS may make available to you offers, discounts and other promotions at its discretion.  Offers, discounts and promotions may expire and are subject to change without notice. Offers, discounts and promotions, including payments and rewards received as a result of any promotion, are nontransferable and cannot be combined with any other promotions, offers, or discounts or redeemed for cash.  In the event of any conflict between these terms and conditions and the terms and conditions of any promotion offer, or discount, the terms and conditions of the promotions will control.

For recurring clients, PSS will offer 25% off your first clean.  To qualify for this discount, you must book and complete five (5) recurring services.  If you do not complete 5 recurring cleanings, you will be charged the one time cleaning price based on your home size plus any additional time requested.

PSS reserves the right to make and/or cancel offers from time to time and such current offers can be found on PSS’ website and are current and available to any qualifying Customer during the period the offer is active.

Liability

Any disputes between you and a Service Professional will be resolved between you and the service professional directly. YOU HEREBY AGREE TO RELEASE ANY OFFICERS, DIRECTORS,AFFILIATES, MEMBERS, SUCCESSORS, ATTORNEYS, EMPLOYEES, AND AGENTS OF PSS ANDFROM ANY DAMAGES OR CLAIMS (INCLUDING CONSEQUENTIAL AND INCIDENTAL DAMAGES) OFEVERY KIND OR NATURE, SUSPECTED AND UNSUSPECTED, KNOWN AND UNKNOWN, ANDDISCLOSED OR UNDISCLOSED, ARISING OUT OF OR IN ANY WAY CONNECTED WITH SUCHDISPUTES AND YOUR DEALINGS WITH SERVICE PROFESSIONALS.

Conflict of Interest/Interferencewith Business Operations

PPS invests time, effort, and finances to identify and contract with its Independent Contractors. Hiring our current or previous independent contractors and/or accepting side propositions makes you liable for an employment referral fee of $1,000.00 if you directly employ (legally or cash basis) anyone currently or formerly who is or was contracted with us as an independent contractor with PSS within a one(1) year period prior to such employment. By using our service, you agree to notify us of any attempts to solicit or accept business by any Service Professional.

Errors and Omissions

Occasionally there may be information on this website that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, and availability. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information or cancel orders if any information on this website is inaccurate at any time without prior notice to you.

Intellectual Property

1. This Site and all of its contents, including, but not limited to its text, photographs, images, illustrations, graphics, logos, formatting, audio, video, selection, arrangement and overall website design and appearance (collectively, the “Intellectual Property”) are protected by copyright, trade dress, trademark and other laws of the United States. The Intellectual Property displayed on or as apart of this website is owned and controlled by PPS or the party credited as the provider of the Intellectual Property.

Links to Other Websites

This Site may contain links to other websites. PPS assumes no responsibility for the content or functionality of any non- PSS website to which we provide a link.

Severability

If any provision of these Terms and Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions.

Governing Law

Any claim relating to PSS’ website shall be governed by the laws of the State of Texas without regard toits conflict of law provisions.
